Mui Kai Ming, the brother of late Cantopop diva Anita Mui was revealed to have failed in his claims against Edko Films regarding the use of the Anita trademark.
On 25 July, the Hong Kong High Court dismissed the lawsuit after stating that Mui could never win the case with his two Class 14 registered trademarks as it was limited to the category of precious metals, jewellery and time instruments.
Meanwhile, the judge stated that Edko Films’ biopic “Anita” was a movie about the said singer and could not be considered infringing on his trademarks.
In addition to having his claim dismissed, he was also asked to pay the legal costs.
When asked about the dismissal, Mui stated that he will appeal the case, calling the verdict unfair.
“If I continue to lose, all the trademarks can be stolen and used by another,” he said, adding that the film industry cannot use the trademark of Anita Mui.
It is noted that aside from the said 14 trademarks, Mui has also applied for six defensive trademarks covering computer and scientific devices, printed matter, leather goods, clothing and advertising, as well as entertainment and cultural activities.
